These Terms of Service ("Terms") govern your use of mobile applications published by Eibo Games ("we", "our", "us"), including Hue Rush (collectively, the "Apps"). By downloading or using our Apps, you agree to these Terms.
Our Apps are provided for personal, non-commercial entertainment. You may not:
Our Apps may offer in-app purchases ("IAP") for virtual items such as gems, coins, power-ups, and cosmetic items. All purchases are processed through Google Play or the Apple App Store and are subject to their terms and refund policies.
Gems, coins, paints, keys, power-ups, and other virtual items earned or purchased within the Apps are licensed to you, not sold. We retain all rights to these virtual items. Your license to virtual items is limited, non-transferable, revocable, and subject to these Terms.
Our Apps may display advertisements provided by third-party ad networks. You may occasionally be offered the option to watch ads in exchange for in-game rewards. Interacting with ads is voluntary. We are not responsible for the content or practices of third-party advertisers.
Game progress is stored locally on your device. We are not responsible for loss of game data due to device failure, app uninstallation, operating system updates, or other circumstances beyond our control. We may offer optional cloud save features in the future.
All content in our Apps — including but not limited to artwork, music, sound effects, game design, code, text, and trademarks — is owned by Eibo Games or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any App content.
We may update, modify, or discontinue the Apps or any features at any time without prior notice. We do not guarantee uninterrupted or error-free operation. Maintenance, updates, or other factors may temporarily disrupt access.
We may suspend or terminate your access to the Apps at any time if you violate these Terms. Upon termination, your license to use the Apps and any associated virtual items is revoked.
The Apps are provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Eibo Games shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Apps, including but not limited to loss of data, loss of virtual items, or interruption of gameplay.
Our Apps are intended for a general audience. If you are under the age of majority in your jurisdiction, you should review these Terms with a parent or guardian. Parents and guardians are responsible for supervising their children's use of the Apps, including any in-app purchases.
These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Apps shall be resolved through good-faith negotiation or, if necessary, through binding arbitration.
We may update these Terms from time to time. Continued use of the Apps after changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
